Abstract

One of the important amendments made in the constitution with the act no. 6771 is related to decrees of presidency. With this amendment, was the president authorized to issue a decree about matters related to executive power in order to meet the need of regulation. The authority to supervise decrees of presidency was given to the constitutional court with constitutional amendment law. Decrees of presidency have been subject to concrete norm control with an amendment in article no. 152 of constitutional law. Decrees of presidency do not only have regulatory function, but also have function of individual administrative act like top government officials’ appointment and their dismissal. However, there is no clause in the constitutional law regarding that decrees of presidency about these matters are subject to administrative judicial review. In that case, it was concluded that supervising decrees of presidency that especially function individually is a problematic area. That is why this matter was discussed in this study, and some suggestions were offered.
