Abstract

Bir işletmede meydana gelen etiğe uygun olmayan veya yasalara aykırı faaliyetlerin, işletme içindeki veya dışındaki yetkili mercilere bildirilmesi olarak tanımlanan ihbarcılık, son yıllarda çeşitli yönleriyle yoğun biçimde tartışılmaktadır. Bu tür faaliyetler gizlilik içinde yürütüldüklerinden dolayı, bilinen kontrol yöntemleriyle tespit edilmeleri oldukça güçtür. Bu nedenle son yıllarda içsel ve dışsal ihbarlarla, etik dışı veya yasa dışı durumların ortaya çıkarılması ve gerekli önlemlerin alınması yaklaşımının yaygınlaştığı görülmektedir. İşletmeyle ilgili oldukça geniş çıkar gruplarına doğru ve güvenilir bilgiler sunma yükümlülüğü sebebiyle, muhasebe mesleği, sosyal sorumluluk ve kamu yararı boyutu bulunan bir meslektir. Hizmet sunduğu bir işletmede yasalara ve düzenlemelere aykırı bir durumla karşılaşan muhasebe meslek mensubu, bunun yetkili mercilere ihbarı konusunda kararsızlık yaşayabilmektedir. Bunun temel sebebi, yasalar ve meslek etiği ilkelerinin, ihbarcılık konusunda yol göstericiliğinin yetersiz olması ve ihbarcılığa yönelik olumsuz toplumsal algıdır. Bu çalışmada ihbarcılık kavramı, muhasebe meslek etiği düzenlemeleri çerçevesinde incelenmekte ve bu kavramın muhasebe mesleği ile ilişkisi tartışılmaktadır. Çalışmanın amacı, muhasebe meslek etiği düzenlemelerinde ihbarcılık konusuna yönelik yaklaşımların ortaya konulmasıdır. Mevcut düzenlemeler göz önüne alındığında gizliliğin genel ilke olarak benimsendiği, ihbarcılığın ise istisnai bir durum olarak görüldüğü anlaşılmaktadır. Muhasebe Meslek Mensupları İçin Uluslararası Etik Standartları Kurulu (IESBA) Etik Kuralları’nda yapılan ihbarcılıkla ilgili önemli bazı revizyonlarla bu yaklaşımın değişmeye başladığı söylenebilir. Böylelikle muhasebe mesleğinde ihbarcılık kavramı gündeme gelmiş ve bu konudaki belirsizlikler ortadan kalkmaya başlamıştır. Çalışmanın, muhasebe meslek etiğine yönelik çalışmalara bu yönüyle katkı sağlaması beklenmektedir.

Abstract

In recent years, whistleblowing which defined as the notification of incompetent or illegitimate activities in a business to competent authorities within or outside the business have been intensively discussed in various ways. Because such activities are carried out confidentially, it is very difficult to be detected with common control methods. For this reason, in recent years, internal and external whistleblowing have led to uncover widespread unethical or illegal situations and taking the necessary precautions for them. Accounting job is a profession with a dimension of social responsibility and public interest duty because of the obligation to provide accurate and reliable information to a wide range of interest groups. A professional accountant who has encountered a situation contrary to the law and regulations in a business that serves can be indecisive about the declaration to the competent authorities. The main reason for this is the inadequacy of the guiding principles of laws and professional ethics codes, and the negative social perception of whistleblowing. In this study, the concept of whistleblowing is examined within the frame of accounting profession regulations and the relation of this concept with the accounting profession is discussed. The aim of the study is to put forward the approaches about the issue of whistleblowing in the accounting profession ethics regulations. Considering the existing regulations, it is understood that the confidentiality is adopted as a general principle and the whistleblowing is regarded as an exceptional situation. It can be said that this approach has begun to change with some important revisions related to whistleblowing made in International Ethics Standards Board for Accountants (IESBA) Code of Ethics. Thus, the concept of whistleblowing in the accounting profession has begun to rise and the uncertainties in this issue have come to an end. It is expected that the study will contribute to the literature of accounting ethics in this direction.
